Zambian Opposition Leader "Hakainde Hichilema" Set Free || 9Jatrendz™
THE State has entered a nolle prosequi against opposition United Party for National Development (UPND) president Hakainde Hichilema and five others accused of treason for not giving way to the presidential motorcade in Mongu.
Particulars of the offence are that between 5th and 8th April 2017 in Lusaka and Mongu, Mr. Hichilema and his co-accused (Hamusonde Hamaleka, Muleya Hachinda, Laston Mulilanduba, Pretorius Haloba, and Wallace Chabala) jointly and whilst acting together allegedly conspired to usurp the executive power of the state in a matter of both public and general nature by overt acts.
All the accused have been in state custody since 11th April, 2017
When the matter came before Judge Charles Chanda of Ndola who was sitting in Lusaka, today
The Director of Public Prosecutions Lillian Shawa Siyunyi informed the court that the state had discontinued the matter in relation to article 180 paragraph 7 of Laws of Zambia.
“At this juncture I would like to inform the honorable court that I am entering a nolle prosequi in respect of all the accused persons before you having regard to Cap 187 of the Constitution of the Republic of Zambia. Article 180, paragraph seven of the laws of Zambia, Siyunyi said.
Justice Chanda discharged matter and freed the accused.
“The DPP has decided to terminate these proceedings by virtue of her constitution power. Therefore, you are hereby discharged from this offense. But this is not an acquittal as at any time, you can be arrested for this offense but for now you are free to go home.”
The State was represented by Director of Public Prosecutions Lillian Siyuni and Seven other lawyers while Vincent Malambo and others lawyers defended the accused.
